Education Policy Experts React to Dismissal of Lawsuit on GA Education Tax Credit Program

Late last week, Fulton County Superior Court Judge Kimberly M. Esmond Adams dismissed claims made in a lawsuit that the Georgia Education Expense Credit program is unconstitutional, stating in her ruling, "Courts that have already considered whether a tax credit is an expenditure of public revenue have answered this question in the negative."

Lennie Jarratt, Education Project Manager for The Heartland Institute, reacted to Judge Adams' ruling by stating that "The Georgia legislature should immediately raise or eliminate the artificial cap on the Education Expense Credit program allowing more interested donors to donate and opening this opportunity to many more students in Georgia."
